The petitioners seek bail in a case registered under Sections 436, 302/34 of the Indian Penal Code. The prosecution case, in brief, is that informant's mother was burnt to death by the accused persons.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 18-11-2018 Charge sheet has already been submitted. The petitioners have falsely been implicated in the present case. There is no eye

Patna High Court CR. MISC. No.6236 of 2019(3) dt.23-04-2019 2/2 witness to the alleged occurrence. The petitioners have been made accused in this case merely on the basis of suspicion. There is no motive alleged against the petitioners for committing the alleged crime.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bihar Sharif, Nalanda in connection with Noorsarai P.S. Case No. 306 of 2018.
