Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The children of the two families had quarreled, which led to commission of assault by the elders. Petitioner No.1, Ram Awatar Dom allegedly caused injury at the head of the mother of the informant with a rod, as a result whereof she died on way to the hospital. The doctor who performed postmortem examination found head injury as cause of death.

Patna High Court CR. MISC. No.6483 of 2019(3) dt.22-04-2019 2/2 Petitioner No.1, Ram Awatar Dom is in custody since 09.09.2018.

Considering the nature of allegation against petitioner No.1, Ram Awatar Dom, I am not inclined to enlarge him on anticipatory bail. Hence, his prayer for bail is refused. The learned trial court is directed to expedite the trial.

Let the remaining petitioners i.e. petitioner No.2, Rang Bahadur Dom and petitioner No.3, Hira Muni Devi, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Dehri (T) Police Station Case No.796 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
