JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Admittedly, petitioner and informant are full brothers and both parties have lodged cases against each others. In the present case, it is alleged that petitioner opened fire causing firearm injury on the abdomen of the informant whereas in counter case, it is alleged that a quarrel took place between the parties on the point of receiving pension of mother of informant and petitioner and in that quarrel, informant of the present case gave sword blow on the neck of petitioner's son as a result of which petitioner's son sustained injury.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that
Patna High Court Cr.Misc. No.27281 of 2015 (2) dt.03-08-2015 2/2 petitioner is in jail custody since 07.01.2014, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Naya Gaon P.S.
