The petitioner is languishing in jail custody since 09.07.2014 in a case registered for the offences punishable under Sections 364, 365, 368/34 of the Indian Penal Code and subsequently, Section 302/201 of the I.P.C. has been added. The learned counsel for the petitioner submits that he is not named in the F.I.R. and his name has transpired due to the confessional statement of one of the co-accused, Ranjan Kumar. It may be noted that in the same and similar allegations, a Co- ordinate Bench of this Court has already been granted bail one of the co-accused, Pankaj Kumar vide order dated 28.05.2015 passed in Cr. Misc. No. 12846 of 2015.

No.29202 of 2015 (2) dt.05-08-2015 2/2 Considering the vagueness of the allegation and also the fact that confessional statement before the police has no evidentiary value and even otherwise, petitioner having a clean antecedent, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Purnia in connection with Sessions Trial No. 1227 of 2014 arising out of Banmankhi P. S. Case No. 162/2014.
