Let the defects, if any, pointed out by the office be removed within four weeks from the date of this order, failing which the matter be listed again under the appropriate heading for necessary action.

Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Angarghat P.S. Case No. 75 of 2020 dated 21.09.2020 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

The main submissions advanced by learned counsel for petitioner are that the instant matter relates to the recovery of 122.625 litres of country made liquor but the same was recovered from a room and bathroom of primary school and petitioner was not arrested at the spot and his name as well as

Patna High Court CR. MISC. No.6856 of 2023(2) dt.29-04-2023 2/2 names of co-accused persons were disclosed by local villagers and the petitioner has fair and clean antecedent and has been languishing in jail since 01.12.2022 and against him the investigation has been completed.

Learned APP for the State has opposed the bail prayer of the petitioner.

Considering the above submissions and mainly the petitioner's fair and clean antecedent and completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Angarghat P.S. Case No. 75 of 2020.
