The petitioner is apprehending his arrest in connection with Mahial P.S.Case No.79 of 2015 registered for offences punishable under Sections 498(A), 467, 468, 471, 120(B), 420, 341, 323, 504, 506 of the Indian Penal Code. This case is under Section 498(A) of the IPC and the petitioner happens to be husband.

Submission of the learned counsel for the petitioner is that up till now four cases have been lodged by the informant/wife against the petitioner and in three cases he has been granted bail and in one of the cases, the petitioner was directed to pay Rs.1100/- to the informant which is being paid. Heard learned A.P.P. and the learned counsel for the informant, who has opposed the prayer for bail on the ground

Patna High Court Cr.Misc. No.4040 of 2019(3) dt.22-02-2019 2/2 that the processes under Section 82 of the Cr.P.C. have already been issued against the petitioner..

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.

With the aforesaid observation, this application is disposed of.
