The petitioner seeks bail in connection with Ghorasahan (Jitna) P.S. Case No.463 of 2021 registered for the offence under Sections 147, 148, 149, 447, 448, 341, 342, 307, 364, 302, 120B of the Indian Penal Code and Section 25(1-b)a, 27 and 35 of the Arms Act.

Allegation against the petitioner is to have committed murder of husband of the informant and assaulted the informant and informant's side, along with other co-accused persons and also kidnapped the daughter of the informant. 4.

Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.13005 of 2024(2) dt.29-02-2024 2/3 petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that petitioner is father of the informant and there is no specific allegation against this petitioner and he has no concern with the alleged occurrence, where, allegation against this petitioner is general and omnibus in nature. It is also submitted that other similarly situated co-accused persons by a learned co-ordinate Bench of this Court through Cr. Misc. No.73693 of 2023 on 01.12.2023. It is further submitted that petitioner is in custody since 02.11.2021.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Ghorasahan (Jitna) P.S. Case No.463 of 2021 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 13th Additional Sessions Judge, East Champaran at Motihari on the following conditions:

(i) Petitioner shall co-operate in the trial and shall be properly represented on each and

Patna High Court CR. MISC. No.13005 of 2024(2) dt.29-02-2024 3/3 every date fixed by the trial Court and shall remain physically present as directed by the trial Court and on their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the trial Court.

(ii) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.

(iii) One of the bailers shall be close relative of the petitioner who has sworn affidavit in this miscellaneous petition.
