JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-05-2020 Heard Mr. Kumar Sunil, learned counsel for the petitioner and Mr. Sanjay Kumar Singh for the State. The petitioner seeks bail in connection with Bhabua P.S. Case No. 673 of 2019 dated 05.11.2019 instituted for the offences under Sections 414, 467, 468 and 471 of the Indian Penal Code.
On secret information that a stolen motorcycle is kept in the house of one Shiv Parsan Paswan, a raid was conducted and the motorcycle was recovered. From the owner book it appeared that name of Shiv Parsan Paswan was entered in it. Aforesaid Shiv Parsan Paswan disclosed that he has purchased the motorcycle from the petitioner. Learned counsel for the petitioner has submitted that this is an information which has been provided by a coaccused from whose possession stolen motor cycle was recovered. The petitioner has got no connection with the
Patna High Court CR. MISC. No.5010 of 2020(4) dt.29-05-2020 2/2 stolen motorcycle.
The petitioner is a person of clean antecedent and is in custody since 06.11.2019.
As opposed to this, the learned counsel for the state has submitted that the investigation in this case is still pending and the petitioner is a professional lifter of two wheelers.
However, considering the nature of accusation against the petitioner and his period of custody and also taking into account his clean antecedent, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur (Bhabua) in connection with Bhabua P.S. Case No. 673 of 2019.
