JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This is an application for grant of anticipatory bail in connection with Basantpur P. S. Case No.405 of 2019 disclosing offences under Sections 272, 273, 308 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act. Recovery of 360 ml of liquor from the house of the petitioner.

Submission of the learned counsel for the petitioner is that recovery is not from the residential house of the petitioner, rather from the abundant house. He has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing
