Petitioner is accused in connection with Baruraj P.S. Case No. 149 of 2015 registered under Sections 399, 402, 414, 120(B), 120(A), 122, 123 of the I.P.C., 3/4/5 of Explosive Substances Act, 25(1-b)A, 26(ii), 35 of the Arms Act and 10, 13, 16(b), 18, 19 and 20 of the U.A.P. Act.
The accusation is that on receiving secret information about assembling the miscreants for making plan of heinous offence, the Police reached near Pipra School, while the petitioner and two others were apprehended by the police and others succeeded to flee away, whose name was disclosed by the petitioner and two others. On search, the petitioner was found in
Patna High Court Cr.Misc. No.20709 of 2016 (2) dt.17-05-2016 2/2 possession of one country made pistol along with two live cartridges.
Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case. It also submitted that petitioner has no criminal antecedent and is in custody since 10.12.2015.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge-cum-Spl. Judge, Muzaffarpur in connection with Baruraj P.S. Case No. 149 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner. (Rajendra Kumar Mishra, J) Shail/- U T
