JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with Araria (Bairgachi) P.S.Case No. 301 of 2015 registered under Sections 147, 148, 149, 302, 354, 504, 379, 506 and 120(B) of the Indian Penal Code.
Accusation is that accused persons, named in the FIR, came in the courtyard of the informant and started to abuse her husband for pouring down rain water. In that course all assaulted the husband of the informant. At that time co-accused- Sajauddin climbed on the chest of the husband of the informant and caused injury to the husband of the informant and also looted articles of the house. While the husband of the informant was taken for treatment, he died in the way.
Patna High Court Cr.Misc. No.19446 of 2016 (2) dt.06-05-2016 2/2 Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner. Specific allegation is against co-accused Sajauddin but from perusal of Post Mortem Report it appears that no external injury was found rather internal spleen was found ruptured.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria, in connection with Araria (Bairgachi) P.S.Case No. 301 of 2015.
