Petitioner seeks bail in a case registered for the offences punishable under Sections 302,120B of the Indian Penal Code and 27 Arms Act.

The informant got information that his son Nitish Kumar Singh @ Chotu Kumar had been killed by causing firearm injury. The petitioner and others are under suspicion as co-accused-Chullu Baba @ Chullu Kumar was in love affairs with co-accused-Khusbu Kumari. Petitioner is mother of Khusbu Kumari.

The impugned order does not reveal that any direct material is there depicting the petitioner's involvement.

No.12714 of 2021(2) dt.05-07-2021 2/2 Learned counsel for the informant opposed the prayer for bail on the ground that the dead body was found near the house of the petitioner and the reason for murder was extra marital relation between co-accused-Khusbu Kumari and coaccused-Chullu Baba @ Chullu Kumar. Considering the nature of material against the petitioner and completion of investigation, let the petitioner, above named, who is a female, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sahar P.S.Case No.247 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
