This application is for grant of regular bail in connection with Chakia P.s.Case no.221 of 2016 for the offences under Sections 420, 406 and 409 of the Indian Penal Code. Petitioner happens to be headmaster of the school and the amount of Rs.7,25,451/- was allocated to the petitioner for construction of the additional class room. Allegation is that the petitioner has not completed the work and defalcated the amount.

Submission of the learned counsel for the petitioner is that she has superannuated in the year, 2013 and she is ready to return the amount which are due against her. Heard learned A.P.P. also.

No.6231 of 2020(2) dt.04-02-2020 2/2 Having heard both sides and in view of submissions as made above, this application is disposed of with a direction to the learned court below to call for a report from the Block Education Officer regarding the extent of work, which has been done in the school and after receipt of the report and if thereafter any amount is due and the petitioner is ready to return the same in two equal installment, the learned court below shall grant provisional bail to the petitioner for a period of three months in order to deposit the total amount and on failure provisional bail of the petitioner shall be cancelled. With the aforesaid observation, this application is disposed of.
