JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-04-2019 Petitioners seek bail in anticipation of their arrest in connection with Complaint Case No. 259 of 2017, registered for the offences punishable under Sections 498A, 406, 504, 506 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act in which cognizance has been taken under Sections 504, 506 IPC and Section 3/4 of Dowry Prohibition Act.
Allegation against the petitioners, who happen to be mother-in-law and Debar of opposite party No.2, is of subjecting her to torture with respect to non-fulfilment of demand of dowry.
Patna High Court CR. MISC. No.6350 of 2019(4) dt.01-04-2019 2/2 Submission of learned counsel for the petitioners is that husband of opposite party No.2 has already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 6.2.2019 in Cr.Misc.No.6576 of 2019 and there is no specific allegation attributed against them. Heard learned APP and learned counsel for opposite party No.2, who has opposed the prayer for anticipatory bail of the petitioners.
Having heard both sides and in the facts and circumstances and also considering the fact that husband has already been granted anticipatory bail, the provisional bail granted to the petitioners vide order dated 5.2.2019 is, hereby, confirmed in connection with Complaint Case No. 259 of 2017, pending in the court of S.D.J.M., Naugachia, Dist.
