JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-02-2019 The petitioners seek bail in anticipation of their arrest in connection with Katihar Nagar Sahayak P.S. Case No. 836 of 2018 dated 28.10.2018 instituted for the offences under Sections 341, 323, 324, 379, 504, 506, 307, 34 of the Indian Penal Code.

The petitioner No. 1 is alleged to have assaulted the father of the informant by means of a spade leading to injuries on his toe. The petitioner No. 2 is alleged to have assaulted the sister of the informant by hard and blunt substance. The petitioner No. 3, however has been attributed with the allegation of assaulting the informant by means of a sword on his head.

The learned counsel for the petitioners has

Patna High Court Cr.Misc. No.5806 of 2019(2) dt.01-02-2019 2/2 submitted that the injuries suffered by the informant and his father, both, are simple in nature. There does not appear to be any injury on the person who is said to have been assaulted by petitioner No. 2. The subject F.I.R was lodged after the petitioner No. 2 had earlier filed a case against the informant and others.

Regard being had to the aforesaid facts as also taking into account the clean antecedents of the petitioners, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar Nagar Sahayak P.S. Case No. 836 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
