The petitioner is languishing in custody since 29.04.2015 in connection with Sessions Trial No. 646 of 2015, arising out of Danapur P.S. Case No. 232 of 2015 for the offences instituted under Sections 302/34 of the IPC and 27 of the Arms Act. The prosecution story, in brief, is that on 27.04.2015, the informant got information that his brother Md. Ilias has been murdered and his dead body is lying on the North of Mainpura Road, Patna.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 29.04.2015 and the charge sheet has been submitted in the present case. The petitioner is not named in the FIR. In
Patna High Court Cr.Misc. No.18565 of 2016 (4) dt.25-05-2016 2/2 course of investigation, merely on the basis of suspicion he has been made accused. There is no circumstantial evidence to suggest his implication in the present case.
On behalf of the State it has been submitted that the petitioner is not named in the F.I.R. and merely on the basis of suspicion he has been made accused.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 7th, Danapur, Patna, in connection with Sessions Trial No. 646/2015, arising out of Danapur P.S. Case No. 232 of 2015.
