JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Complaint Case No. 1684 of 2016 for the offence under Sections 406 and 420 of the Indian Penal Code. Allegation against the petitioner as per the complaint case is that he was a broker of the land and in the process of sale, the complainant was cheated.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He placed on record the sale deed and the documents to show that the complainant voluntarily granted No Objection in the matter of mutation of the land.
Considering the aforesaid, the petitioner named
Patna High Court CR. MISC. No.6974 of 2020(2) dt.28-02-2020 2/2 above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of ACJM-IX, Bhagalpur in connection with Complaint Case No. 1684 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
