11-08-2015 Heard learned counsel for the petitioners, learned Additional P.P. as well as learned counsel for the informant. The petitioners seek bail in Harnaut P.S. Case No. 55 of 2015, registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. The informant alleged that while the informant, his brother along with others were constructing a drain, petitioners along with other accused persons came and made indiscriminate firing. The informant further alleged that Shrawan Yadav fired on his brother Sunil Yadav at his mouth who died on the spot. No other persons got injured. Petitioners of course alleged to have made

Patna High Court Cr.Misc. No.30008 of 2015 (2) dt.11-08-2015 2/2 indiscriminate firing but nobody got injured. Learned counsel for the informant vehemently opposed the prayer for bail.

Considering the facts aforesaid and the fact that the petitioners are not the assailant of the deceased Sunil Yadav, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Biharsharif at Nalanda, in connection with Harnaut P.S. Case No. 55 of 2015.
