The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Jamui Complaint Case no. 1379 of 2019 instituted for the offence under Sections 354B, 380, 342, 341, 457, 34 and 506 of the Indian Penal Code.
As per complaint petition, petitioner along with coaccused Manoj Chaudhary entered into the house of complainant and attempted to commit rape upon the complainant and also taken away ornaments and cash of Rs. 20,000/- from her house.
Learned counsel appearing on behalf of the petitioner
Patna High Court CR. MISC. No.7559 of 2020(4) dt.27-10-2021 2/2 has submitted that petitioner is innocent and has been falsely implicated in the present case. He has got no criminal antecedent. Neither the petitioner was arrested on spot nor any incriminating article has been recovered from his possession. There is case and counter case between the parties. Learned APP has opposed the prayer of bail of the petitioner.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Jamui Complaint Case No. 1379 of 2019, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui subject to the conditions as laid down under section 438(2) of the Cr.P.C.
