The petitioner is accused in connection with Imamganj P.S. Case No. 23 of 2016, registered under Section 399 and 402 of the Indian Penal Code and Section 25(1b)a/26/35 of the Arms Act. The prosecution case is that on receiving secret information about gathering of miscreants for making preparation to commit heinous crime, the Police reached near Harenkel Shiv temple, where three persons including the petitioner were apprehended, while two persons succeeded to flee away. On search, the petitioner was found in possession of one Samsung mobile and one phone diary, whereas one loaded pistol and six live cartridges recovered from the possession of

Patna High Court Cr.Misc. No.19621 of 2016 (2) dt.10-05-2016 2/2 Ashok Mahto and one loaded pistol and three live cartridges recovered from the possession of Mantu Singh. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion. The petitioner having no criminal antecedent is in custody since 24.02.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Gaya at Sherghati in connection with Imamganj P.S. Case No. 23 of 2016. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
