Three petitioners, who are grand-father, uncle and father respectively of main accused, namely, Sudhir Kumar, have approached this Court with a prayer to extend the privilege of bail, in the event of their arrest or surrender in Obra P.S. Case No. 122 of 2018 registered for the offence under Sections 341, 323, 354, 366A/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the victim voluntary had went with the son of petitioner no. 3 for solemnizing marriage, however informant (father of the victim)
Patna High Court CR. MISC. No.8141 of 2019(3) dt.05-04-2019 2/2 maliciously arrayed all the petitioners, including son of petitioner no. 3 as accused. He further submits that during investigation, statement of the victim under Section 164 of the Code of Criminal Procedure was recorded, in which she has not at all made any allegation against either of the petitioners. The submission of learned counsel for the petitioners was not disputed by Sri Pandey, learned Addl. Public Prosecutor. In view of facts and circumstances, in the event of their arrest or surrender within a period of six weeks from today, let aforesaid three petitioners, namely, 1. Shyamnandan Singh,
2. Bageshwar Singh @ Birendra Singh, 3. Rabindra Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar in the district of Aurangabad in connection with Obra P.S. Case No. 122 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
