In this case, petitioner is challenging the award dated 8.4.2017 by which the Collector as an Arbitrator has decided the matter against him. The petitioner has filed this writ petition challenging the aforesaid award.
A proceeding has been initiated under the Arbitration and Conciliation Act, 1996 and in terms of the agreement the Collector was appointed as Arbitrator to decide the case. There is provision under Section 34 of the Arbitration and Conciliation Act, 1996 which provides that if any person is aggrieved by the award he may challenge the same before the
Patna High Court CWJC No.11309 of 2017 (3) dt.21-08-2017 Principal Civil Court.
In such view of the matter, this writ petition is not maintainable.
Accordingly this writ petition is dismissed.
