The petitioner has prayed for bail in a case registered for the offence punishable under sections 25(1-B)-25, 26 and 35 of the Arms Act.

Prosecution case relates to recovery of five cartridges were recovered which was kept below the pillow of the petitioner, who was sleeping at the roof of the house of Uday Manjhi.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The alleged recovery has not been made from the house of the petitioner. There is violation of Section 100 Cr.P.C. Petitioner is languishing in judicial custody since 2.6.2022.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gaya in connection with Bodhgaya P.S. Case No. 290 of 2022.
