Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in Sonepur P.S. Case No. 368 of 2019, registered for the offences punishable under Sections 341, 323, 325, 307, 354B, 504, 506 and 34 of the Indian Penal Code and section 27 of the Arms Act. Petitioner is alleged to have fired upon the informant and others.

It is submitted that petitioner has been falsely implicated in this case. There is general and omnibus allegation.

There is no fire arm injury. No offence under Section 307, 354(B) and section 27 of the Arms Act has been made. The informant has also lodged another case bearing no. Sonepur P.S. Case No. 367 of 2019 for the same occurrence in which informant has not named this petitioner.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 5th, Saran at Chapra in connection with Sonepur P.S. Case No. 368 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
