2. This criminal appeal has been filed against the order dated 18.12.2023 passed by learned Special Judge SC/ST, East Champaran, Motihari in ABP No. 5953 of 2023 in connection with Sangrampur P.S. Case No. 335 of 2023, registered under Sections 302/34 of the Indian Penal Code and Section 3(i)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, whereby the prayer for anticipatory bail of appellant has been rejected.
3. As per prosecution case, all the F.I.R. named accused including this appellant, on 1.10.2023, took away
Patna High Court CR. APP (SJ) No.425 of 2024(3) dt.12-09-2024 2/2 grandson of informant, assaulted and killed him by strangulation and hanged him on tree. It is further alleged that around 3 AM, this appellant along with co-accused Anil Singh, armed with weapons, came at the door of informant and abused him by caste name and told him that they have killed his grandson.
4. Considering the nature of accusation and gravity of offence, I do not find any ground to interfere with the order of the learned court below and as such, the appeal, which has been filed for grant of anticipatory bail, is hereby rejected. (Prabhat Kumar Singh, J) Navya/- U T
