Mr. Ashok Kumar Jha, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-03-2025 Heard learned counsel for the petitioners, informant and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 406, 420, 379, 498(A), 504, 506/34 of the Indian Penal Code.
3. As per prosecution case, marriage of informant was solemnized with Saroj Kumar Sharma on 05.11.2012 and her husband died on 16.05.2021 during Corona. Thereafter, informant was subjected to cruelty and torture by these petitioners and in collusion with each other, they transferred Rs.
Patna High Court CR. MISC. No.6423 of 2025(3) dt.17-03-2025 2/3 13,25,653/- from the joint account of informant and her late husband on different dates. It is further alleged that these petitioners also took 12 ATM cards of the husband of informant and subsequently, ousted informant and her two daughters from the matrimonial house on 20.10.2022.
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case due to family feud. As a matter of fact, petitioners are brothers of deceased husband of the informant and after receiving ex gratia compensation of Rs. 4 lacs from the Government, informant performed second marriage with one Suresh Thakur (Sharma) and only with a view to harass the petitioners she has lodged this false and concocted case against them. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond
Patna High Court CR. MISC. No.6423 of 2025(3) dt.17-03-2025 3/3 of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Pupri at Sitamarhi in connection with Sitamarhi P. S. Case No. 106 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
