JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Huge quantity of country made liquor was recovered from a pick-up- van, which was being carried by the petitioners and others.
Contention on behalf of the petitioners is that petitioners are labourers and, as a matter of fact, the aforesaid seized liquor belongs to one Ajay Kumar Singh, who has license for selling country made liquor. Moreover, petitioners do not have any criminal antecedent and are languishing in jail custody since 19.03.2016 (wrongly mentioned in the impugned order as
Patna High Court Cr.Misc. No.20112 of 2016 (2) dt.09-05-2016 2/2 16.04.2016).
Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni Refinary P.S.Case No. 106 of 2016.
