The petitioner apprehends his arrest in connection with Imamganj P.S. Case No.170 of 2018 registered under Sections 420, 467, 471 and 120(B) of the Indian Penal Code. The accusation is that in the light of the direction issued in Public Interest Litigation Case No.15459 of 2014, the vigilance inquiry was started regarding the verification of the certificate of employed primary teachers, in which it was detected that the certificates of CPED submitted by Basudev Prajapati, Block Teacher, Middle School, Kendua, BlockImamganj, District-Gaya, and Lalan Kumar, Block Teacher, Middle School, Khesra, Block-Imamganj, District-Gaya,
Patna High Court CR. MISC. No.10568 of 2019(3) dt.14-05-2019 2/3 employed by the Block Level Schools, are forged. Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner was the Pramukh of Panchayat Samiti, Imamganj, and on that very basis, he was the Chairman of the Selection Committee of Panchayat Prakhand Teacher along with other members including Block Education Extension Officer but the duty of verifying the certificate according to rules is of the Executive Officer of the Panchayat Samiti. Further submission is that Basudev Prajapat alias Basudev Prajapati and Lalan Kumar, both block teachers, vide order dated 29.03.2019 passed in Criminal Misc. No.19292 of 2019 and Raj Ballabh Prasad, Block Education Extension Officer, vide order dated 03.05.2019 passed in Criminal Misc. No.
14424 of 2019, have already been granted the privilege of pre-arrest bail by different Bench of this Court. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Sherghati (Gaya), in connection with Imamganj P.S.
