Petitioner is in custody in connection with Sitamarhi P.S. Case No. 689 of 2019 for the offence under sections 272, 273/34 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

In the instant case total 48.600 liters of Nepali Saufi Wine was seized from the possession of the petitioner. The petitioner is in custody since 2.12.2019. Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner,

Patna High Court CR. MISC. No.6314 of 2020(2) dt.03-02-2020 2/2 let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge,Excise, Sitamarhi, in connection with Sitamarhi P.S. Case No. 689 of 2019.
