JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.

Two persons were arrested from a lodge and the aforesaid apprehended persons disclosed the name of the petitioner and others and also disclosed that they had stayed in the lodge with an intent to commit dacoity. Petitioner is in jail custody since 15.1.2016 and having more or less similar allegation, coaccused Md. Mikail @ Mikail has already been granted privilege of bail by a Co-ordinate Bench of this Court.

Patna High Court Cr.Misc. No.20436 of 2016 (2) dt.13-05-2016 2/2 Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Kotwali (Tatarpur) P.S. Case No.541 of 2014.
