Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-AA), 26(i)(ii) and 35 of the Arms Act.

Firearm was recovered from a hut and it is alleged that the hut was of the petitioner. Petitioner was not there at the time of recovery of firearm. Petitioner is in custody since 07.10.2020. Investigation of the case against the petitioner is already complete.

Submission is that the hut is not of the petitioner. Considering the period already undergone by the petitioner and completion of investigation, coupled with the fact that there is no material to substantiate that the petitioner is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.16021 of 2021(4) dt.25-10-2021 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Beldaur Police Station Case No. 265 of 2020, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.

(c) The petitioner shall not leave the country without permission of the learned trial court.
