Petitioner seeks bail in a case registered under sections 461, 379, 295, 411, 414, 420 of the Indian Penal Code as well as section 25 of the Antiques & Treasure Act and section 30 (i) (iii) of the Ancient Monument and Archeological Sites & Remains Act. Neither petitioner is named in the first information report nor anything was recovered from his conscious possession. Idol of this case appears to have been recovered from the outskirt of the village. The name of the petitioner sprang in this case in the confessional statement of co- accused and later on, petitioner, too, confessed his guilt.
It appears that except the aforesaid material, there is nothing against the petitioner.
Accordingly, petitioner is directed to be released on bail on
