The petitioner seeks bail in a case under Section 304 and other sections of the Indian Penal Code.

On account of offering flowers and garlands some altercation took place between the father of the informant on one side and the petitioner and others on the other. On the order of Nandan Panda, Rajan Panda caught the father of the informant and petitioner, Chhotu Panda, is alleged to have assaulted with iron rod.

The prayer for bail of the petitioner was earlier rejected vide order dated 26.03.2015 passed in Cr. Misc. No. 8905/2015 with an observation that the petitioner may renew his prayer for bail after remaining eight months in jail.

Patna High Court Cr.Misc. No.35509 of 2015 (2) dt.12-08-2015 2/2 The police after investigation submitted charge sheet under section 304 of the IPC. The petitioner is in jail since 22.10.2014. The petitioner has already remained in jail for ten months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in Kotwali P.S. Case No. 295/ 14.
