2. The petitioners seek bail in connection with Ghorasahan P.S. Case No. 628 of 2023 registered for the offence punishable under Sections 394/302 of the Indian Penal Code.
3. As per the F.I.R., the petitioners are said to have killed the deceased. After investigation, the chargesheet has been submitted under Section 304/279/34 of the Indian Penal Code against the accused persons.
4. Mr. Yogesh Chandra Verma, learned Senior Counsel for the petitioners submits that the deceased died in an
Patna High Court CR. MISC. No.12257 of 2024(3) dt.18-04-2024 2/2 accident and this false prosecution case was made out by the informant. The petitioner are in jail since 08.11.2023.
5. Considering the period of custody and also the fact that the petitioners have no criminal antecedents, let the petitioners above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran/ concerned court in connection with Ghorasahan Police Station Case No. 628/2023.
