JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-02-2025 At the outset, learned counsel for the petitioners submits that seeks permission to withdraw this anticipatory bail petition so far as petitioner no. 2 namely Ram Layak Mehta is concerned.

2. The anticipatory bail petition stands dismissed, so far as petitioner no. 2 is concerned.

3. Sole petitioner (i.e. petitioner no. 1) apprehends her arrest in a case registered for the offence under Sections 126(2), 115(2), 118(1), 109(1), 352, 351(2), 3(5) of the Bhartiya Nayay Sanhita, 2023.

4. As per F.I.R., due to family feud, while co-accused Ram Layak Mehta (husband of petitioner) was quarreling with

Patna High Court CR. MISC. No.4881 of 2025(2) dt.13-02-2025 2/2 informant, this petitioner brought iron rod from house and gave it to her husband (co-accused Ram Layak Mehta), by which, he assaulted on the head of informant, causing grievous injury.

5. Learned counsel for the petitioner submits that petitioner is Bhabhi of informant and there is no allegation of assault or overt act against her. Petitioner is lady and has got clean antecedent.

6. Learned A.P.P. for the State and learned counsel for the informant opposed the prayer for anticipatory bail petition.

7. Considering the aforesaid facts & circumstances, in the event of arrest/surrender within a period of eight weeks from today, let the petitioner namely Reshma Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) P.S. Case No. 789 of 2024, subject to condition as laid down under Section 482 of Bhartiya Nagrik Suraksha Sanhita, 2023.
