The petitioner is languishing in custody since 06.01.2015 in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379, 504 and 506/34 of the Indian Penal Code.

The prosecution case is that the FIR named accused persons including the petitioner was assaulting the nephew of the informant when informant went to rescue then this petitioner made assault with Farsa on the head of the informant. It is submitted by learned counsel for the petitioner that the injury report of the informant contained in Annexure-3 reflects that some superficial injury was found caused

Patna High Court Cr.Misc. No.15135 of 2015 (03) dt.23-06-2015 2/2 by hard and blunt substance. There is counter version of the occurrence also.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate (West), Muzaffarpur in connection with Motipur P.S. Case No. 190 of 2013.
