JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The victim has already been recovered and her statement was recorded under section 164 of the Cr.P.C. In her statement recorded under Section 164 of the Cr.P.C., the victim stated that she had gone along with the petitioner by her own sweet will but, later on, she was recovered from the house by the police . The victim also admitted that she was in love with the petitioner.
No doubt, the victim was minor at the time of alleged occurrence but there is nothing in the statement of victim to show that she was allured by the petitioner.
Accordingly, let the petitioner, above named, be
Patna High Court Cr.Misc. No.21068 of 2016 (2) dt.20-05-2016 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Jamui in connection with Sono P.S.Case No. 28 of 2016.
