This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Kursakanta (Sonamani Godam) PS Case No. 47 of 2018 for the alleged offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. In the instant case, total 297.3 liters of Nepali liquor was seized and the name of the petitioner surfaced on the confessional statement of one Dinesh Keshri who has been granted bail by a Co-ordinate Bench of this Court in Cr.Misc.No. 23104 of 2018 vide order dated 27.04.2018.

No.3885 of 2019(2) dt.25-01-2019 2/2 Having regard to the fact that petitioner has no criminal antecedent, and the co-accused who has disclosed the name of the petitioner has been granted bail and also the fact that petitioner is in custody since 27.10.2018, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Addl. Sessions Judge-cum-Special Judge, Araria in connection with Kursakanta PS Case No. 47 of 2018.
