The petitioner being husband is in custody since 21.03.2018 seeks bail in Sahajitpur P.S. Case No. 73/2017 corresponding to Sessions Trial No. 664/2018, registered for the offence punishable under Sections 304(B), 328, 201 and 34 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected thrice by this court, but now in view of the fact that the witnesses have turned hostile, petitioner has renewed his prayer for bail.

The status report regarding stage of trial has been received by the lower court, in which it has been submitted that out of six witnesses, three witnesses have already been

Patna High Court CR. MISC. No.6419 of 2019(3) dt.27-02-2019 2/2 examined and the trial is underway.

Considering the fact that the trial is at its fag end, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
