JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-04-2025 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioners apprehend their arrest in a case registered for the offence under Sections 103(1), 3(5) of the Bhartiya Nyaya Sanhita.
3. As per the prosecution case, on 08.11.2024 at 2:15 hrs., the informant received an information that her son namely Amardeep Kumar has been stabbed with knife at Madhurapur Gote and as such, she went there and saw the dead-body of his son. The reasons for the occurrence is that co-accused Rupesh Kumar had uploaded a photo of Amardeep's sister on facebook and Amardeep had gone to question him.

Learned counsel for the petitioners submits that as per F.I.R., it is specific case of the informant that her son (deceased) had gone to meet co-accused Rupesh Kumar, who had uploaded obscene picture of his sister and thereafter, coaccused Rupesh Kumar stabbed knife in the chest of deceased. The doctor has found one stab injury on the person of deceased and there is no specific allegation of assault against these two petitioners. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State and learned counsel for the informant opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Pupri, Sitamarhi, in connection with Bajpatti P.S. Case No. 308 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
