JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner was arrested in course of investigation and, allegedly, two pairs of Payal, one Samsung mobile set and Rs.4300/- in cash were recovered from conscious possession of the petitioner. The investigating officer claims that the aforesaid seized articles are looted articles of the present case. Submission on behalf of the petitioner is that the seized mobile and articles belong to the petitioner and it is further submitted that petitioner had purchased the seized mobile. To fortify the above stated contention, he filed photo stat copy of the purchase receipt of the mobile. So far as the recovery of Rs.4300/-

Patna High Court Cr.Misc. No.19980 of 2016 (2) dt.06-05-2016 2/2 in cash is concerned, it is submitted that the same also belongs to the petitioner.

No doubt, petitioner carries criminal antecedent of several cases but taking into consideration the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub- Divisional Judicial Magistrate, Raxaul at Motihari in connection with Adapur P.S.Case No. 04 of 2016.
