JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 09-05-2023 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State. The petitioner seeks bail in connection with Isuapur P. S. Case No. 148 of 2021 registered for the offence under Section 394 of the Indian Penal Code.

The accused/petitioner is not named in the F.I.R. and is in custody since 22.02.2022.

The allegation against the petitioner is to commit robbery, along with other co-accused persons, and while committing so taken away motorcycle and other articles like bag and mobiles as found in possession of informant. Learned counsel appearing on behalf of the petitioner submitted that petitioner was implicated with present case on

Patna High Court CR. MISC. No.5506 of 2023(2) dt.09-05-2023 2/3 the basis of self confession while apprehending in Baniapur P. S. Case No. 03 of 2022. It is submitted that in furtherance of said confession, nothing incriminating surfaced/recovered, during the course of investigation, which may incriminate petitioner with the present occurrence of robbery. It is further submitted that petitioner was not put on TIP, as yet. While traveling over the argument, it is submitted that on the same day when petitioner was arrested in Baniapur P. S. Case No. 03 of 2022, he was named in six (6) more criminal cases but despite of same, he was remanded in two (2) cases only out which one is the present. While concluding the argument, it is submitted that investigation of this case is completed, for which, charge-sheet has submitted, as such, there is no chance of tampering with the evidence.

Learned APP, while opposing the prayer of bail submitted that petitioner is a man of criminal antecedents. In view of the facts and circumstances as mentioned above, as name of the petitioner appears in this case on the basis of self-confession, where no incriminating material recovered/surfaced, during the course of investigation, to connect this petitioner, prima facie, with the present set of occurrence of robbery, where petitioner is in custody since

Case No. 148 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran/concerned Court, subject to the conditions as laid down u/s 437(3) of the Cr.P.C.
