The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 363, 365 and 370 of the Indian Penal Code.
The prosecution case is that on 01.02.2016 at 5.00 A.M. the informant's sister Puja Kumari went out to bring flowers but she went traceless. The informant came to know that she has been abducted by Sunil Kumar and his relative Chunnu Pandit for flesh trade purposes. It was also alleged that Sunil Kumar's brothers and sister were also involved in the same.
It is submitted by learned counsel for the petitioner that the petitioner is married sister of Sunil Kumar,
Patna High Court Cr.Misc. No.20281 of 2016 (2) dt.10-05-2016 2/2 hence, she has been roped in the present case and she resides at her matrimonial house. For the offence of 01.02.2016 the FIR was registered on 04.02.2016.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the thrust of accusation against Sunil Kumar and Chunnu Pandit and petitioner being a lady, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. Case No. 24 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
The bail bonds of the petitioner shall be accepted on filing affidavit that the petitioner will co-operate in the investigation. The non-cooperation in the investigation will give liberty to the learned court below to cancel the bail bonds of the petitioner.
