The petitioner apprehends arrest in connection with G.R.P. Jhajha Rail Police P.S. Case No. 123 of 2018 registered under Sections 379 and 411 of the Indian Penal Code pending in the Court of Rail Judicial Magistrate, Kiul.

Learned counsel appearing on behalf of the petitioner submits that petitioner is on Police Bail under section 41(1) of the Code of Criminal Procedure.

Considering the facts and circumstances of the case, it appears that the matter is well covered by the decision of this Court in the case of Mahendra Prasad Singh Vs. State of Bihar, reported in 2004(3) P.L.J.R., 491.

In view of the above, it is directed that petitioner may

Patna High Court CR. MISC. No.4387 of 2020(6) dt.23-02-2021 2/2 surrender before the Court below within a period of four weeks from today. In case, petitioner surrenders and files an application for bail, the concerned Court will pass an order in the similar manner as has been decided in the case of Mahendra Prasad Singh (Supra).

With the above directions/observations, this application is disposed of.
