JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner, learned counsel for the Vigilance and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Special Case No. 07 of 2012, arising out of Bhabhua P.S. Case No. 533 of 2011 for the offences instituted under Sections 420, 409, 467, 468, 471/34, 120(B) of the Indian Penal Code, Section 13(2) read with section 13(1)(d) of Prevention of Corruption Act, 1988.

The allegation against the petitioner is that he has committed financial irregularities of huge amount as per the report of the State Health Society and it was found that he made payment to the N.G.Os., Private Nursing Homes and Private

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner runs a nursing home under a welfare scheme. He was to conduct the operation in respect to family planning. The allegation is that the petitioner has misused an amount of Rs. 9,750/-. It is further submitted that the petitioner is ready to deposit an amount of Rs. 10,000/- in the court below which shall be subject to final disposal of the case. On behalf of the State and the counsel for the Vigilance, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs. 10,000/- in the court below, which shall be subject to the final disposal of the case and on doing so, let the petitioner above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Special Case No. 07 of 2012, arising out of Bhabhua P.S. Case No. 533 of 2011 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount
