The petitioners seek bail in a case registered for the offence punishable under Section 302/34 of IPC. It is alleged that the petitioners caught hold of the son of the informant, thereafter one Golu Patwa caused knife injury on the side abdomen of the son of the informant, who, later on, succumbed to his injuries.

It is submitted that there is no allegation of assault against the petitioners. Specific allegation of assault is against one Golu Patwa.

It is further submitted that the petitioners have earlier

Patna High Court Cr.Misc. No.28506 of 2015 (2) dt.10-08-2015 2/2 moved this Court for anticipatory bail in which it has been observed that facts constitute a good ground for consideration of prayer for regular bail. The petitioners have no criminal antecedent.

Considering the facts and circumstances, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra /court concerned in Bhagwan Bazar P. S. Case No. 196 of 2014 with following conditions:-

1. The petitioners will not indulge themselves in similar or any other offence.

2. One of the bailors must be the close relative of the petitioners.

3. The petitioners will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, their bail bond would be liable to be cancelled by the learned Court concerned.
