The petitioner seeks bail in connection with Sessions Trial No. 107 of 2015 arising out of Munger Muffasil P.S. Case No. 91 of 2014 instituted under various sections of the Arms Act.

His prayer for bail was earlier rejected vide order dated 05.11.2014 passed in Cr. Misc. No.40039 of 2014. It has been contended that though the petitioner is in custody since 16th May, 2014, no witness has been examined so far during trial. Learned counsel for the petitioner has submitted

Be that as it may, regard being had to the fact that ten country-made pistol are alleged to have been recovered from the house of the petitioner, I am not inclined to grant bail to the petitioner at this stage.

The court below is directed to frame charges forthwith and conclude the trial as early as possible, preferably within seven months from the date of receipt/production of a copy of the order, failing which the petitioner would be entitled to renew his prayer for bail before the court below itself.
