The petitioner seeks bail in a case registered for the offences under sections 147, 148, 149, 448, 302, 201 of the Indian Penal Code and section 27 of the Arms Act. The prosecution story, in short is that on 07.06.1995 at about 4.0 P.M. while the informant was sitting in her house with her son, 10-15 accused persons variously armed came and surrounded the house of the informant and fired upon the son of the informant who died on the spot. It has been submitted on behalf of the petitioner that the petitioner is in custody since 03.01.2015. Charge-sheet has been submitted in the case. There is no allegation of

Patna High Court Cr.Misc. No.29985 of 2015 (4) dt.18-12-2015 tampering of evidence against the petitioner. General and omnibus allegation has been made against the petitioner. No specific injury has been attributed against him. Other co-accused have been granted bail vide Criminal Misc. No. 36617 of 2012. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the facts aforesaid, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the 3rd Ad-hoc Additional Sessions Judge, Khagaria in connection with Session Case No. 340-B of 2011 arising out of Beldaur P.S.
