JUSTICE SATYAVRAT VERMA ORAL ORDER 09-03-2022 Heard learned counsel for the petitioner and Mr. Bishweshwar Ram learned A.P.P. for the State. The petitioner seeks bail in connection with Excise Case No. 1222 of 2021 arising out of Kaler P.S. Case No. 87 of 021 instituted for the offences under Sections 30(a) & 42 of the Bihar Prohibition & Excise Amendment Act, 2018. Learned counsel for the petitioner submits that the petitioner is in custody since 20.12.2021, charge-sheet has been submitted in the case and has antecedent of one case and allegation is of recovery of 3546 liters of liquor from a Truck kept in gunny bag.
Learned counsel for the petitioner submits that the petitioner is a driver of the truck and as such he was not knowing what was kept in the truck by the owner and

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 20.12.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II cum Special Judge, Excise, Jehanabad in connection with Excise Case No. 1222 of 2021 arising out of Kaler P.S.
