JUSTICE PARTHA SARTHY ORAL ORDER 23-07-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Dalsinghsarai P.S. Case no. 109 of 2020 registered under section 376 and other sections of the Indian Penal Code and section 4 of the POCSO Act. As per allegations in the F.I.R., the 16 years old informant was raped by the son of the petitioner. It is further stated that on the family members of the informant going to the house of the accused, his parents including the petitioner herein started a fight.

It is submitted by learned counsel for the petitioner that the petitioner who is a lady has been implicated in the case only for the reason that she happens to be the mother of the main accused. She has no criminal antecedent and is in custody

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the investigation in the case having concluded, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Dalsinghsarai P.S. Case No. 109 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Court, POCSO, Samastipur.
